Lead Counsel- Strategic Litigations

JOB PURPOSE
The position is envisaged to handle the critical, high stake and strategic litigations of Delhi International Airport Limited (DIAL). The incumbent will also handle the litigations of Goa Airport in close coordination with the legal head of Goa Airport. Such litigations will involve arbitrations, tariff matters, the writ petitions, the SLPs, the matters before NGT and also critical appeals before the High courts and the Supreme court of India. The incumbent will also review the various judgments and the new laws concerning the Airport business , analyze and update the legal heads of Airports business on the impact/precedent value of the judgments and new laws on the Airport business and also advise the management about the mitigations measures or representations or suggestions to be made concerning the same.
The incumbent will manage all the above functions under closed coordination with the Chief legal Officer -North &West sector of the Airport business.

FINANCIAL DIMENSIONS
Currently there are many litigations pending before Delhi High Court at the original side, appellate side as well as the application/ appeals u/s 34 and 37 of Arbitration and Conciliation Act, 1996. Litigations are pending before TDSAT (as the appellate tribunal) concerning the tariff and regulatory issues of Delhi and Goa Airport. Litigations are pending before the Supreme Court against the appeals filed against the orders of TDSAT.
The incumbent has to handle the litigations within the available expense budget for the year.

EDUCATION QUALIFICATIONS
- LL.B. is must
- L.L.M is preferred
- Ability to understand accounting and commercial aspects
- Law graduate from a reputed university with post qualification experience of around 15 years in the litigation field.
- Well versed with court procedures and should have sound knowledge of Indian Legal provisions & regulations with expertise in handling litigation thereby providing effective support in all branches of law.
- Ability to handle litigations matters pertaining to commercial, contractual, regulatory, property tax, operational, compliances, constitutional matters (writ jurisdiction), company petitions, environmental, eviction proceedings, arbitration and mediation, risk analysis and mitigation, trial administration and corporate representation.
- Interfacing with external counsels, tracking progress & formulating strategies as well as ensuring adequate defence in cases.
- Assessing pleadings of external counsels by giving inputs where ever required, attending court proceedings on the date of hearing
- Preparing response to various legal notices and other formal communications & advising business teams on legal issues with business friendly solutions and action plan to mitigate risk.
- Periodic updates to promoter group with key priority litigation updates impacting the business.
- Proactive support and advice in identification of counsels, rationalization of arguing counsels.
- Manage/ handle Legal due diligence on litigation matters for audit and transactional purpose.
- Negotiations with external counsels for finalization of legal fees.
- Managing/handling legal due diligence on litigation matters for audit and transactional purpose.
- Providing effective advice to the business teams through adequate research, on various commercial issues having legal implications.
